כִּי תִבְנֶה בַּיִת חָדָשׁ, וְעָשִׂיתָ מַעֲקֶה לְגַגֶּךָ; וְלֹא-תָשִׂים דָּמִים בְּבֵיתֶךָ, כִּי-יִפֹּל הַנֹּפֵל מִמֶּנּוּ  (דברים כב:ח)

זאת מצווה קלה ופשוטה, שאין אדם חייב לרדוף אחריה. אבל אם בנה (או רכש) בית שגרים בו ושמשתמים בגגו -- אזי חייב לבנות גם "מעקה" סביב לגג כדי למנוע נפילת אדם מן הגג. ופירוש "מעקה" מחיצה קטנה. וככל מחיצה הלכתית, גובהה לא פחות מעשרה טפחים  (הל' רוצח ושמירת נפש יא:א-ג).

ומעניינת לשון התורה: כִּי-יִפֹּל הַנֹּפֵל מִמֶּנּוּ -- שלכל הנראה נגזר על האדם הזה למות בנפילה. אם כן, למה תטרח לשים מעקה? הרי ייפול מכל מקום! אלא שאינך חייב להיות האמצעי דרכו ה' מממש את גזירתו -- לֹא-תָשִׂים דָּמִים בְּבֵיתֶךָ. וכן בשאר נזקים: וְכֵן כָּל מִכְשׁוֹל שֶׁיֵּשׁ בּוֹ סַכָּנַת נְפָשׁוֹת -- מִצְוַת עֲשֵׂה לְהָסִירוֹ וּלְהִשָּׁמֵר מִמֶּנּוּ וּלְהִזָּהֵר בַּדָּבָר יָפֶה יָפֶה, שֶׁנֶּאֱמָר "הִשָּׁמֶר לְךָ וּשְׁמֹר נַפְשְׁךָ"  (הל' רוצח ושמירת נפש יא:ה).

ובחודש אלול הזה, בו מתכוננים לראש השנה ויום הכיפורים -- חייבים להתבונן ולבדוק ולמצוא כל מכשול וכל נזק שגרמנו או שלא הסרנו -- בין לעצמנו, בין לאחרים -- ולהסיר כל אחד שנודע לנו. למען ייטב לנו ולכל עם ישראל, שלא ייגרם שום נזק ומכשול על ידינו.
